How does a buyer end up paying too much tax?

The tax rules for purchasing a property can be complex and sometimes even conveyancers or estate agents can get it wrong.

The amount of SDLT a buyer will pay depends on the value of the property they are purchasing and whether they are entitled to any reliefs (discounts) on their SDLT bill. Your conveyancer or estate agent might have told you how much SDLT you needed to pay but they may not have calculated the amount correctly, or did not claim a relief that you were entitled for and which would have meant you paid less tax.

Each Stamp Duty claim and any compensation award depends upon the facts of the individual case.

Anyone purchasing a property
can overpay SDLT, including:
  • First time buyers
  • Businesses
  • Property developers
  • Landlords
